Online Bidders Payments must be made by 1pm CST on the first business day (Monday) following the auction UNLESS agreed upon. $25 Per-Day Late Fee will be added. ***All tax forms must be submitted before payment, or you will be charged sales tax*** WIRE INSTRUCTIONS will be emailed with Invoice. Ground Bidders MUST pay day of Sale! TN does not recognize Streamlined Ag Exemption Forms; you will need a TN Ag Exemption Certificate from TN.gov Taxes & Fees TENNESSEE AUCTIONS Applicable State of Sales Tax will be charged on all Lots. ~TAX EXEMPTION QUALIFICATIONS~ *MUST have a TN Ag Exemption Card-Out of State Residence CAN Apply for a TN Ag Exemption **NO STREMLINED FORMS ACCEPTED** Your out of State Ag Exemption Card will NOT apply. *Certificate of Resale-Any state will apply for exemption* 9.75% Sales tax must be collected unless valid exemption is presented at checkout. 1% Buyers Premium will be added to the final bid. Online Bidding Provided by: Equipment Facts Credit Cards 4% Administrative Fee No items will be removed from sale site without receipt of payment in full. Bids placed at this auction are a legally binding contract. All sales are final. Ferge Auctions reserves the right to hold any items from removal until full payment is verified. All purchases must be removed from the premises by deadline. Deadline is Wednesday following the Auction, unless agreed upon. Loader may not be available after Wednesday ***Invoices and Titles have to read the same*** TITLES WILL BE PROCESSED HOW YOU REGISTER, INCLUDING NAME & ADDRESS If you purchase an item with a TITLE, Please make sure your information is correct on your invoice. All titles are mailed to the registered address unless requested otherwise. Terms & Conditions: Buyer is RESPONSIBLE for doing his or her own inspections. ALL information we provide for items such as Serial Numbers, Weights, Horsepower, Lift Capacities, Length, Height, etc., is taken from sources generally deemed to be accurate, but not guaranteed. Hour meter readings or mileages are unverified information and accuracy is not guaranteed in any way and is the winning bidder's responsibility to verify prior to purchase. All items sell AS-IS, WHERE-IS. No warranty expressed or implied on auction items. All sales are final. All bids are a legally binding contract, and all sales are final. Announcements made day of sale takes precedence over all advertising. 1) Buyer will pay an Internet Purchase Fee on the "hammer price" (winning bid amount) for all online purchases. 2) Bidders are personally responsible for any bids made with their Bidding Number. If the highest bid for any particular lot is submitted using your Bidding Number, you are responsible and liable for any payments due hereunder, without protest, set-off or claim against the Auctioneer or Equipmentfacts LLC ("Equipmentfacts"). 3) The highest bidder for each Lot shall be the Purchaser, and in the event of any dispute the Auctioneer and Equipmentfacts shall have absolute discretion either to settle such dispute as they determine or to re-offer the lot for sale. 4) Neither Auctioneer nor EquipmentFacts shall be liable for any loss or damage howsoever arising (including but not limited to costs of attendance of Bidders at the Auction) from any Lots not presented for sale. 5) You acknowledge and understand that the descriptions of the Lot(s) in the catalogue for each auction are provided by the Vendor(s) or other third parties over whom the Auctioneer and Equipmentfacts have no control, not by the Auctioneer or Equipmentfacts. The Auctioneer and Equipmentfacts shall not be liable for any deficiencies, misstatements, misrepresentations and/or errors in any description(s), oral or printed, and neither the Auctioneer nor Equipmentfacts guarantee or warrant the authenticity, genuineness, origin, age, condition or quality of any Lot(s), and all statements as to these matters whether contained in the catalogue or made orally are statements of opinion only and not to be taken as being or implying a statement or representation of fact by the Auctioneer or Equipmentfacts. All claims against the Auctioneer and Equipmentfacts, and their respective employees and agents, arising out of or related to any Lot description are hereby waived and forever released. 6) Each and every Lot is sold "as-is, where-is." The Auctioneer and Equipmentfacts provide no guarantees or warranties whatsoever, express or implied, in respect of the equipment contained in or constituting a Lot. All representations made by the Auctioneer and Equipmentfacts, as well as their respective employees or agents, are to be considered lay opinions only and neither the Auctioneer nor Equipmentfacts shall be liable for any purchase made by a Buyer in reliance upon them, and all such claims arising out of or related thereto are hereby waived and forever released. 7) Please give us a heads up when you are coming to load equipment so we can make sure we are available. Will help load free of charge. 8) The Buyer acknowledges he/she has read and agrees to be bound by the additional terms and conditions set forth herein.
