By registering to bid, you are agreeing to all Auction Terms & Conditions listed herein: 10% Buyers premium will be added to final bid on all items. There is an extra 3% charge if paying with card. All invoices over $10,000 must be paid via wire transfer or cashier's check with ID.

Items must be pair for and picked up the day following the auction. Any items not picked up will be charged to the card on file along with any additional removal fees required.

ALL ITEMS ARE SOLD AS IS WHERE IS with no warranties or guarantees expressed or implied by Van Massey Auction & Realty. It is the BUYER'S responsibility to inspect all items prior to bidding.Van Massey Auctioneers has attempted to provide accurate descriptions of all items, however, it is the bidder's responsibility to determine the condition and suitability of each lot. Printed statements or descriptions by Van Massey Auction staff are provided in good faith and are matters of opinion ONLY. ALL SALES ARE FINAL. If there is a video of a piece of equipment, that only shows the operability of the machine at the specific time the video was taken. You are still highly encouraged to inspect all items in person prior to bidding. We do not guarantee hours/mileage on any equipment or vehicle. 

YOU ARE RESPONSIBLE FOR ALL BIDS PLACED ON YOUR ACCOUNT. No bids will be retracted, whether "accidental" or not. Please be aware of what you are doing.

Titles for vehicles, trailers, etc. will be mailed to new owner within 30 days of payment. No titles will be given out at auction pickup regardless of payment. Only trailers/campers, ATVs, etc. specifically with "Title" listed in the item description will be accompanied with a title. Titles will be placed in the name of the registered buyer. The buyer will be responsible for paying any required sales tax at your local courthouse.

In the event of non-payment of items, the bidder shall assume all court costs associated with collection of payment in court. Any debt collection or dispute proceedings will be heard in Lincoln County, TN. If items are not paid for on the specified pickup date, Van Massey Auctioneers has the authority to charge the credit card on file for any outstanding invoices, including all storage fees.

ALL FIREARMS SELL IN ACCORDANCE WITH ATF REGULATIONS. You must pass a background check in order to purchase a firearm. If you fail the background check, you will not be refunded the buyer's premium. DO NOT BID IF YOU CANNOT PASS A BACKGROUND CHECK. $20 check fee for first firearm, $10 for each additional firearm.

No Buybacks: Sellers are contractually prohibited from bidding on lots they have consigned to the auction.

Soft Close: This auction has a soft close feature, meaning if a bid is placed within the last 2 minutes of a lot closing then time will be extended an additional 2 minutes onto the time left remaining. Stagger Close: This auction features a stagger close which means items end in several second increments. each auction may have a different stagger time amount. larger auctions will have a smaller stagger time to ensure the entire auction ends in a timely manner. An example of a stagger close is this. The auction is set to start ending at 7pm. This does not mean all lots will end at 7pm. If the stagger time is set to 10 seconds then lot 1 will end at 7:00:00pm, lot 2 will end t 7:00:10, lot 3 will end at 7:00:20 and so on until all lots have ended. Note: bidding can extend on a lot if a bid is placed withing the last 2 minutes of the item ending. See the paragraph above to explain the "soft close' feature.

 All items purchased must be picked up and paid for on the specified day and time. No exceptions. Please be prepared to pay for and pick up items on this day before you place a bid on any items.  Please call our office if you have any questions regarding the pickup times and location 433-8686 ANY ITEMS NOT PICKED UP ON DESIGNATED PICKUP DAY WILL BE ASSESSED A $25 PER DAY STORAGE FEE UNLESS ARRANGEMENTS ARE MADE PRIOR TO AUCTION END..

Some items sell subject to seller approval. The auctioneer reserves the right to bid on behalf of the seller. The buyer assumes full responsibility of property once the item is declared sold. RISK OF LOSS: Buyer agrees to obtain full liability insurance coverage for their items as may be required by law.

SMALL ITEMS Can be shipped! NOTE: IF YOU REQUIRE SHIPPING YOU MUST CALL OUR OFFICE TO PAY WITH CARD EVEN IF YOU HAVE A CARD ON FILE. CALL 931-433-8686 TO PAY WITH CARD. After you pay,your items will be turned over to our third party shipper and you can arrange shipping with them. Cost of shipping will be paid directly to our third party shipper by YOU!

The buyer is responsible for arranging shipping/freight for larger items. All items must be paid for in full before removal.

Items must be picked up the fay following the auction to avoid storage fees. ANY ITEMS PAID FOR AND NOT PICKED UP WITHIN 30 DAYS WILL BE CONSIDERED ABANDONED AND RESOLD TO PAY THE STORAGE FEE. Please see the details page for loadout dates and times.

Van Massey Auction and Realty is not responsible for any software, bidding platform, or internet connection issues. The auctioneer has the authority to pause, delay, or remove an auction or item at any time deemed necessary.

Any bid placed on your behalf of your account is a legal, binding contract. You are responsible for any bids placed. NO BIDS WILL BE RETRACTED.
