Buyer's Premium: There will be a 10% Buyer’s Premium added to the winning bid. The sum of the winning bid plus the Buyer’s Premium will be the sale price. 

SALES TAX: Kentucky Sales Tax (6%) will be added to the sale price. Dealers or other exempt parties must provide proper documentation to Auctioneer. Farmers claiming farm exemption must have a Kentucky Agriculture Number. 

Must be 18 years old to bid.

Max Bids: Using the Max bed feature is recommend to avoid chances of internet issues during the close of the auction. But using the Max bed feature the program will bid for you without you having to log in or watch the close of the auction. 
 
Butler Auctioneers, LLC Online Auctions are timed events, and all bidding will close at the specified time. Butler Auctioneers, LLC Online Auctions also have an auto-extend feature. The auto-extend feature remains active until no further bids are received within the time limit. Please monitor the countdown timer to see when the lot will close. 
 
Staggered Closing: This online auction closes in intervals. Please monitor the countdown timer to see when the lot will close. Please check the auction announcements for detailed information regarding these intervals. This feature works great with the auto-extend feature to closely emulate a live auction.

All property is sold in "AS IS" and "WHERE IS" condition. ALL SALES ARE FINAL! The bidder understands and agrees that no refunds, exchanges, or adjustments will be allowed. Property is available for inspection at specified times, and it is the bidder's responsibility to determine the condition. Bidder's failure to inspect any item or lot will not constitute grounds for any claim, refund, adjustment. 
 
All description information has been gathered from sources which we believe to be reliable but is not guaranteed. Auctioneer makes no warranty or guarantees of any kind with respect to condition, authenticity, provenance, source, condition, suitability for a particular purpose, etc. The auctioneer reserves the right to change, modify, delete any item or lot or description in the auction as may be necessary. 
 
Payment, Pickup, Shipping & Storage Terms: 

Payment Info: Accepted methods of payment are cash, cashier's check, wire transfer, credit card will be accepted on purchases under $2500 (a 4% convenience fee added to the total invoice price of all credit card purchases) or personal/business check accompanied with a bank letter of guarantee addressed to Butler Auctioneers LLC for checks over $5,000 if the buyer is not known by the auction company. All fees incurred by wired transfers will be paid by the purchaser. All payments must be paid in full by the last scheduled pick-up date. If items are not paid for within the specified payment dates, Butler Auctioneers LLC has the authority to charge the credit card on file for any outstanding invoices, including storage fees.

Pickup: All Items must be removed by the scheduled pick-up dates listed with each auction unless other arrangements have been made with the auction company. Items cannot be removed until full purchase price has been paid. All items left over night will be full responsibility of the buyers. All items not removed by the last scheduled pick-up date, will be charged a $20 per item, per day fee without prior arrangements being made with the auction company. Any items not picked up by the last scheduled pickup day without arrangements being made with the auction company will be considered abandoned and resold with the auction company retaining all proceeds from the resale of the item.  

Credit Card Terms:
We accept Visa, Master Card & Discover. An additional 4% convenience fee for credit card payment will be added to the invoice. All credit card sales are final, no refunds on credit card payments. A maximum amount of $2,500 will be accepted as payment on a credit card. If items are not paid for within the specified payment dates, Butler Auctioneers LLC has the authority to charge the credit card on file for any outstanding invoices, including storage fees.

It is the buyers responsibility to arrange shipping of large items.

Loading assistance is available for large items.

 Large Item Pickup: Butler Auctioneers, LLC absolutely DOES NOT provide shipping or shipping preparation. Removal of items, moving, packaging, transporting, shipping, and shipping preparation are the sole responsibility of the purchaser. 

 Item Transportation: Butler Auctioneers, LLC must be notified via phone or email of any items that cannot be picked up on an Auction Pickup Day, if we are NOT notified then your items will be forfeited. Any items transported back to a Butler Auctioneers, LLC office/facility are subject to a $10 per lot fee. 

 
Storage of Personal Property Items: Any item stored at a Butler Auctioneers facility past the scheduled pickup dates will be subject to a $25 per day storage fee unless arrangements have been made with the auction company.
 
Forfeiture of Items: Any item/lot that has not been paid for or picked up from any Butler Auctioneers, LLC location by the end of the scheduled pickup times without arrangements being made, at Auctioneer's discretion, be discarded or resold with proceeds retained by the Auctioneer. 
 
 TITLE TRANSFERS: All titles must be transferred before taking possession of items unless the buyer is a dealer or out of state. Contact Butler Auctioneers LLC within 24 hours of the conclusion of the auction to schedule a time to transfer titled vehicles. Vehicles must have insurance before being driven from the location.

SERVER & SOFTWARE TECHNICAL ISSUES: In the event there are technical difficulties related to the server, software, or any other online auction-related technologies, Butler Auctioneers, LLC reserves the right to extend bidding, continue the bidding, or close the bidding. NEITHER THE COMPANY PROVIDING THE SOFTWARE nor BUTLER AUCTIONEERS, LLC SHALL BE HELD RESPONSIBLE FOR A MISSED BID OR THE FAILURE OF THE SOFTWARE TO FUNCTION PROPERLY FOR ANY REASON. Email notifications will be sent to registered bidders with updated information as deemed necessary by Butler Auctioneers, LLC. 
 
Any dispute between Butler Auctioneers, LLC, its Agents or Representatives, and the Buyer(s) will be tried in a court of jurisdiction in Breckinridge County, Kentucky. By bidding on the property, the buyer agrees to all terms and conditions set forth. 
Agency: Butler Auctioneers, LLC Agents and Representatives are agents of the Seller. Buyer and or Bidder agrees to hold harmless and indemnify Butler Auctioneers, LLC and its Agents and its Representatives from any and all claims, damages, or suits including but not limited to awards, judgments, costs, fees, etc. 
 Butler Auctioneers, LLC, reserves the right to alter this agreement at any time. This will take place by updating this site. Please check back and review these terms as every time you use this site you are agreeing to the terms as they are written at that time. Auction company employees and/or auction company may bid on and purchase auction items.    
BIDDER DEFAULT: Failure to complete a purchase is illegal and will result in one or more of the following (1) prosecution (2) loss of bidding privileges with Butler Auctioneers, LLC. $50 returned check fee
 
If a bidder at any time feels his/her username, password, or bidder number has been compromised due to lack of security by the bidder, notify Auctioneer immediately.

By agreeing to the terms and conditions the bidder is allowing Butler Auctioneers LLC to send them reminder emails and text with auction information. There is an opt out option in the emails and text if the bidder does not want to receive the reminders.
